Simone Biles’ brother, Tevin, was acquitted on all charges on Tuesday after he was accused of shooting and killing three men at a 2018 New Year’s Eve party, according to NBC News.
An Ohio judge granted a motion by Tevin Biles-Thomas’ attorneys to dismiss the case based on insufficient evidence. The judge said that, among other things, that witness description of clothing worn by the shooter was “75% accurate at best.”
Biles-Thomas was arrested in 2019 and charged with murder after police said that he shot and killed three men at a New Year’s Eve party at a Cleveland-area Airbnb rental. Three victims — Devaughn Gibson, 23, DelVaunte Johnson, 19, and Toshon Banks, 21 — all died of multiple gunshot wounds. Gibson was Biles-Thomas’ cousin.
Biles-Thomas initially faced 15 charges related to the incident. A judge declared a mistrial in the first trial last month over a paperwork issue.
“It can’t be forgotten that Tevin not only has suffered through two and a half years of defending himself, but he also lost a loved one, too,” said Biles-Thomas’ attorney, Joseph Patituce, via NBC News.
Biles-Thomas rushed by victim’s mother after ruling
The scene in the courtroom got tense after the ruling was handed down on Tuesday.
A mother of one of the victims charged toward Biles-Thomas after the trial was dismissed and yelled out.
“You have to be f***ing kidding me,” she yelled, per NBC News. “I’m going to kill you.”
Officers in the courtroom stopped the mother, who was identified as Johnson’s mom.
“We don’t fault the victim’s family, this was a horrible event,” Patituce said, via NBC News. “We don’t fault the victim’s family for acting out.”
Biles reportedly did not grow up with her brother, as she and her younger sister lived with their maternal grandfather in Houston and Biles-Thomas and their other sibling moved to Cleveland with a different relative.
Biles issued a statement about her brother’s arrest, but has been quiet about the whole situation ever since. The four-time Olympic gold medalist, who just won her seventh U.S. title, is currently preparing for the Tokyo Olympics next month.
