Alec Baldwin to be charged with involuntary manslaughter over ‘Rust’ shooting
Alec Baldwin will be charged with two counts of involuntary manslaughter over the fatal shooting of “Rust” cinematographer Halyna Hutchins, prosecutors announced Thursday.
Santa Fe District Attorney Mary Carmack-Altwies said in a statement that the film’s armorer, Hannah Gutierrez Reed, who oversaw the weapons on set, will also be charged with involuntary manslaughter, which carries a maximum sentence of 18 months in jail.

“After a thorough review of the evidence and the laws of the state of New Mexico, I have determined that there is sufficient evidence to file criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew,” Carmack-Altwies said.
“On my watch, no one is above the law, and everyone deserves justice,” she continued.
Hutchins was fatally shot on the set of the Western film on Oct. 21, 2021, after Baldwin’s prop gun discharged a live round, which hit her in the chest. She was 42 years old.
The movie’s director, Joel Souza, was also wounded, but the DA said Thursday that no charges will be filed specific to his injuries.
An attorney for Baldwin, 64, called the charge against his client “a terrible miscarriage of justice.”
“Mr. Baldwin had no reason to believe there was a live bullet in the gun — or anywhere on the movie set. He relied on the professionals with whom he worked, who assured him the gun did not have live rounds,” Luke Nikas of Quinn Emanuel law firm tells Page Six. “We will fight these charges, and we will win.”
Meanwhile, Halyna’s widower, Matt Hutchins, thanked Carmack-Altwies for the “thorough investigation and determining that charges for involuntary manslaughter are warranted for the killing of Halyna Hutchins with the conscious disregard for human life.”
Matt added, “It is a comfort to the family that, in New Mexico, no one is above the law. We support the charges, will fully cooperate with this prosecution, and fervently hope the justice system works to protect the public and hold accountable those who break the law.”
The charges come after the “Saturday Night Live” alum settled a wrongful death lawsuit with the Hutchins family in October 2022.
Shortly after, Baldwin filed a negligence suit against four crew members — including Gutierrez Reed — for handing him the loaded gun and failing to maintain safety on set.
“This tragedy happened because live bullets were delivered to the set and loaded into the gun,” Baldwin’s lawyer, Nikas, said in the filing.
The Oscar nominee has denied any responsibility for Halyna’s death and even insisted he did not pull the trigger on the set of “Rust,” which was set to resume filming this month.
He has, however, admitted that his life “may never be the same” following the fatal incident.
